Macroeconomic data is sourced from public government and institutional sources and may be subject to revision. Your financial account data is retrieved through Plaid and is dependent on the accuracy and timeliness of information provided by your financial institutions.

The Service uses Plaid Inc. ("Plaid") to connect to your financial institution accounts. Plaid is an independent third-party service provider. When you connect your accounts through the Service, you will interact directly with Plaid's interface ("Plaid Link") and be subject to Plaid's own terms of service and privacy policy.

HGIJersey LLC is not responsible for, and assumes no liability in connection with, the acts, omissions, errors, or service disruptions of Plaid Inc. or your financial institutions. If you experience issues with account connectivity, data accuracy, or data retrieval through Plaid, we will use commercially reasonable efforts to assist you, but we cannot guarantee resolution of issues that originate with Plaid or your financial institution.

Prices are in U.S. dollars and are subject to change. We will provide you with advance notice of any price changes in accordance with the policies of the applicable app store.
All payments for in-app purchases and subscriptions are processed through the Apple App Store (for iOS) or Google Play Store (for Android). HGIJersey LLC does not directly collect or process your payment information (credit card numbers, billing addresses, etc.). Your purchase is subject to the payment terms of the applicable app store.
Because payments are processed through the Apple App Store and Google Play Store, refund requests are subject to the respective app store's refund policies:

Certain features of the Service may be available without a purchase or subscription. We reserve the right to modify, limit, or discontinue free features at any time without notice.
The Service may present comparisons of financial products offered by third-party companies, including but not limited to:

HGIJersey LLC may receive compensation from third-party financial product providers when you click on, apply for, or are approved for a product presented through the Service. This compensation may take the form of referral fees, affiliate commissions, or other forms of payment.

HGIJersey LLC is not responsible for the products, services, terms, conditions, or practices of any third-party partner. If you choose to engage with a partner product, your relationship with that provider is governed by their own terms, conditions, and privacy policies. We encourage you to read those carefully before applying for or purchasing any product.
The Service displays advertisements provided by third-party advertising networks, including Google AdMob. Advertisements may appear within the App across all tiers, including paid tiers (Tack Reports and monthly subscriptions).
Our advertising partners may collect certain information about your device and usage patterns to serve relevant advertisements. This data collection is governed by the privacy policies of the respective advertising networks. For information about how Google AdMob collects and uses data, please refer to Google's Privacy Policy.
We do not endorse, warrant, or guarantee the products, services, or claims made in third-party advertisements displayed within the App. Any transaction you enter into with an advertiser is solely between you and that advertiser. HGIJersey LLC is not responsible for any loss or damage incurred as a result of your interaction with advertised products or services.
You may be able to adjust your advertising preferences and opt out of personalized advertising through your device's settings or through the mechanisms provided by our advertising partners. Please note that opting out of personalized advertising does not eliminate advertisements; it means the ads you see may be less relevant to you.
The Service, including but not limited to the App, website, all content, features, functionality, Insights, algorithms, data models, software code, user interface designs, graphics, logos, trademarks, and documentation, is the exclusive property of HGIJersey LLC or its licensors and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.
"Tack," the Tack logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HGIJersey LLC. You may not use these marks without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a personal device that you own or control, solely for your personal, non-commercial use.

If you provide feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant HGIJersey LLC an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation to you.
You agree not to use the Service in any manner that:
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including without limitation suspending or terminating the offender's account and reporting such conduct to law enforcement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TACK FINANCIAL LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE "TACK PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
(A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES;
(B) ANY DAMAGES ARISING FROM OR RELATED TO: - YOUR USE OF OR INABILITY TO USE THE SERVICE; - ANY FINANCIAL DECISION YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE; - ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE INSIGHTS OR INFORMATION PROVIDED BY THE SERVICE; - ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; - ANY THIRD-PARTY CONDUCT, PRODUCTS, OR SERVICES, INCLUDING PLAID, ADVERTISING PARTNERS, AND AFFILIATE PARTNERS; - ANY INTERRUPTION OR CESSATION OF THE SERVICE;
REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF THE TACK PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE TACK PARTIES FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO TACK FINANCIAL LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
You acknowledge that the limitations of liability in this Section reflect a reasonable allocation of risk and are a fundamental part of the basis of the bargain between you and HGIJersey LLC. The Service would not be provided to you without these limitations.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations in this Section shall apply to the fullest extent permitted by law.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TACK PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
Without limiting the foregoing, HGIJersey LLC does not warrant that:
You agree to indemnify, defend, and hold harmless the Tack Parties from and against any and all claims, demands, actions, suits, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:
This indemnification obligation shall survive the termination of these Terms and your use of the Service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@trytack.app with a written description of your dispute, including your name, the nature of your complaint, and the specific relief you seek. Both parties agree to attempt to resolve the dispute informally for at least thirty (30) days from the date you send your notice. If the dispute is not resolved within this period, either party may proceed as described below.
You and HGIJersey LLC agree that any dispute, claim, or controversy arising from or relating to these Terms, the Service, or the relationship between you and HGIJersey LLC (collectively, "Disputes") shall be resolved exclusively through final and binding individual arbitration, rather than in court, except as set forth in Section 14.5 below.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at https://www.adr.org. If the AAA is unavailable, the parties shall mutually agree on an alternative arbitration forum; if they cannot agree, a court of competent jurisdiction shall appoint an arbitrator.
YOU AND TACK FINANCIAL LLC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action, class arbitration, or other representative proceeding against HGIJersey LLC. If for any reason a court or arbitrator finds this class action waiver to be unenforceable, the arbitration agreement in Section 14.2 shall be deemed void (but the remainder of these Terms shall remain in effect), and any class or representative action must proceed in a court of competent jurisdiction rather than in arbitration.
Notwithstanding the foregoing, either party may bring an individual claim in a small claims court of competent jurisdiction. If the claim is transferred, removed, or appealed to a different court, the arbitration agreement shall apply.
You have the right to opt out of this arbitration agreement. To opt out, you must send written notice to legal@trytack.app within thirty (30) days of first accepting these Terms. Your opt-out notice must include your full name, mailing address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, neither you nor HGIJersey LLC will be required to arbitrate Disputes, and both parties retain their rights to bring claims in court.
This arbitration agreement shall survive the termination of your account and these Terms.
You may terminate your account and stop using the Service at any time by:
If you have an active subscription, you must cancel it through your device's app store settings before or at the time of account termination to avoid further charges.
We may suspend or terminate your account, or restrict your access to the Service, at any time and for any reason, including but not limited to:
Where practical, we will provide you with advance notice and an explanation of the reason for termination. However, we reserve the right to terminate immediately and without notice in cases of serious violations or suspected fraud.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and terminate your account.

These Terms, together with the Privacy Policy and any supplemental terms or policies referenced herein, constitute the entire agreement between you and HGIJersey LLC with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
The failure of HGIJersey LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by HGIJersey LLC.
You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. HGIJersey LLC may assign or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms, except as expressly provided herein.
The section headings in these Terms are for convenience only and have no legal or contractual effect.
By using the Service, you consent to receive communications from us electronically, including via email, in-app notifications, and push notifications. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
By using Tack, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
